признание некоторого лица владельцем ценной бумаги или иного финансового инструмента на основании закона. Подобное право обычно основывается на обладании "правовым титулом" (title); иногда рассматривается как отличное от права собственности бенефициарного владельца, т.е. лица, имеющего право на получение выгоды по финансовому инструменту, например, в ситуации, когда бумаги зарегистрированы на номинального держателя, а доход по ним получает бенефициарный владелец. В подобных случаях номинальный держатель, согласно англо-американскому праву, признается "юридическим владельцем" (legal owner), а реальный владелец является "выгодоприобретателем" (beneficial owner)
